Reporter’s Note
Note that the statute uses the phrase “wittingly, falsely, and deceitfully” and the phrase “wittingly, falsely, or deceitfully.” 13 V.S.A. § 1801. The Committee has no way to reconcile this discrepancy, and this will have to be clarified by the legislature or a court decision. The model instruction includes both “and” and “or” in brackets.
In the second element, courts must select and specify the particular document from the statutory list.
The definitions of “forgery,” “counterfeit,” “utter,” “publish,” and “instrument” derive from Black’s Law Dictionary. The definition of “defraud” derives from Cambridge Dictionary.
