The Vermont Supreme Court has recognized defense of property as a legal defense.  The components derive from case law.  The instruction is drafted in generic form.  It should be tailored to fit the circumstances of each case.  Please note that the committee has not revisited this instruction since the decision in Raynes v. Rogers, 2008 VT 52, 183 Vt. 513.
