{"id":825,"date":"2012-08-09T19:59:04","date_gmt":"2012-08-09T19:59:04","guid":{"rendered":"http:\/\/vtjuryinstructions.org\/?page_id=825"},"modified":"2019-07-12T18:36:11","modified_gmt":"2019-07-12T18:36:11","slug":"dui-definitions","status":"publish","type":"page","link":"https:\/\/vtjuryinstructions.org\/?page_id=825","title":{"rendered":"DUI: Definitions"},"content":{"rendered":"<p style=\"text-align: justify;\">CR30-011.\u00a0 <a href=\"http:\/\/www.vtjuryinstructions.org\/criminal\/MS30-011.htm\" target=\"_blank\">Definition of \u201cAlcohol Concentration\u201d<\/a> (02\/11\/02).\u00a0 Under the statutory definition, the \u201calcohol concentration\u201d may be stated as a number, without corresponding units.\u00a0 Thus the number 0.15 may refer to 0.15 grams of alcohol per 100 milliliters of blood, or it may refer to 0.15 grams of alcohol per 210 liters of breath.\u00a0 Although the \u201calcohol concentration\u201d may roughly correspond to the percentage of alcohol in the blood by weight, it is potentially confusing, and incorrect under the statutory definition, to refer to the number as a percentage, such as 0.15 %.<\/p>\n<p style=\"text-align: justify;\">CR30-031.\u00a0 <a href=\"http:\/\/www.vtjuryinstructions.org\/criminal\/MS30-031.htm\" target=\"_blank\">Definition of \u201cUnder the Influence of Intoxicating Liquor\u201d<\/a> (05\/08\/03).\u00a0 The Supreme Court has repeatedly upheld an instruction that a driver was \u201cunder the influence\u201d if he or she was affected \u201cin the slightest degree\u201d by intoxicating liquor.\u00a0 This so-called \u201cStorrs instruction,\u201d based on <span style=\"text-decoration: underline;\">State v. Storrs<\/span>, 105 Vt. 180, 185 (1933), is appropriate \u201cin cases where testimony supports a claim of loss of control of physical and mental faculties, [but] not where the evidence deals solely with the chemical level of alcohol.\u201d\u00a0 <span style=\"text-decoration: underline;\">State v. Carmody<\/span>, 140Vt. 631, 638 (1982).<\/p>\n<p style=\"text-align: justify;\">A layperson may testify about his or her observations supporting a conclusion that the defendant was under the influence.\u00a0 <span style=\"text-decoration: underline;\">State v. Baldwin<\/span>, 140 Vt. 501, 515 (1981).\u00a0 \u201cRecognition of the fact of intoxication requires no particular scientific knowledge or training.\u201d\u00a0 <span style=\"text-decoration: underline;\">State v.
