{"id":821,"date":"2012-08-09T19:57:52","date_gmt":"2012-08-09T19:57:52","guid":{"rendered":"http:\/\/vtjuryinstructions.org\/?page_id=821"},"modified":"2016-01-10T22:17:28","modified_gmt":"2016-01-10T22:17:28","slug":"dui-phase-ii-enhancements","status":"publish","type":"page","link":"https:\/\/vtjuryinstructions.org\/?page_id=821","title":{"rendered":"DUI: Phase II Enhancements"},"content":{"rendered":"<p>CR30-171.\u00a0 <a href=\"http:\/\/www.vtjuryinstructions.org\/criminal\/MS30-171.htm\" target=\"_blank\">DUI: Second Offense<\/a> under\u00a023 V.S.A. \u00a7 1201(a)(2), Phase II proceeding (04\/22\/03).<\/p>\n<p style=\"text-align: center;\">Reporter&#8217;s Note<\/p>\n<p style=\"text-align: justify;\">When the state seeks to penalize a defendant as a repeat offender, he or she is entitled to a bifurcated proceeding, including a jury trial on the second phase to consider (1) the sufficiency of the record alleged as to the prior convictions, and (2) the defendant\u2019s identity as the person previously convicted.\u00a0 <em>See<\/em> <span style=\"text-decoration: underline;\">State v. Angelucci<\/span>, 137 Vt. 272, 281 (1979); <span style=\"text-decoration: underline;\">State v. Cameron<\/span>, 126 Vt. 244, 249 (1967).\u00a0 Bifurcated proceedings have been used to address repeat DUI convictions, under 23 V.S.A. \u00a7 1210, in <span style=\"text-decoration: underline;\">State v. Carpenter<\/span>, 170 Vt. 371 (2000); <span style=\"text-decoration: underline;\">State v. Porter<\/span>, 164 Vt. 515 (1996); and <span style=\"text-decoration: underline;\">State v. Baril<\/span>, 155 Vt. 344 (1990).<\/p>\n<p style=\"text-align: justify;\">\u00a0To the extent there may be issues over the use of a prior conviction based on a prior law, or based on a conviction from another state, the defendant is not entitled to a jury determination on whether the prior conviction is sufficient under Vermont law.\u00a0 Those issues present pure questions of law.\u00a0 Accordingly, it is the Court\u2019s duty to instruct the jury as to nature and effect of out of state convictions as a matter of law, i.e., whether the elements of the out of state conviction under the other jurisdiction\u2019s law are the equivalent of the Vermont offense. <em>See<\/em> 23 V.S.A. \u00a7 1211 and <span style=\"text-decoration: underline;\">State v.
