Dost<\/span>, 636 F. Supp. 828, 832 (S.D. Cal. 1986), <span style=\"text-decoration: underline;\">aff\u2019d sub nom.<\/span>, <span style=\"text-decoration: underline;\">United States v. Wiegand<\/span>, 812 F.2d 1239 (9th Cir. 1987). Those factors, while not comprehensive or necessarily applicable in every case, have been applied by federal courts throughout the country. <em>See<\/em>, <em>e.g.<\/em>, <span style=\"text-decoration: underline;\">United States v. Brown<\/span>, 579 F.3d 672, 680 (6th Cir. 2009); <span style=\"text-decoration: underline;\">United States v. Moore<\/span>, 215 F.3d 681, 686 (7th Cir. 2000); <span style=\"text-decoration: underline;\">United States v. Goodale<\/span>, 831 F. Supp. 2d 804, 809\u201314 (D. Vt. 2011).<\/p>\n<p style=\"text-align: justify;\">Note that 13 V.S.A. \u00a7 2827 (possession of child pornography) refers to a \u201cclearly lewd exhibition,\u201d while 13 V.S.A. \u00a7 2822 (use of a child in a sexual performance) refers only to a \u201clewd exhibition\u201d and omits the word \u201cclearly.\u201d The model instructions are consistent with the statutory language.<\/p>\n<p style=\"text-align: justify;\"><em>Luring a Child (CR-27-761)<\/em>: The definitions of \u201csolicit\u201d and \u201centice\u201d are derived from Black\u2019s Law Dictionary (10th ed. 2014) (WL). The definition of \u201clure\u201d is based on Merriam-Webster\u2019s Dictionary (online).
