Squiers<\/span>, 2006 VT 26, 179 Vt. 388.\u00a0 \u201c[T]he determination of whether an act is \u2018lewd\u2019 under \u00a7 2602 depends on the nature and quality of the contact, judged by community standards of morality and decency, in light of all the surrounding circumstances, accompanied by the requisite, specific lewd intent on the part of the defendant.\u201d\u00a0 <span style=\"text-decoration: underline;\">Id<\/span>. \u00b6 11; <em>see also<\/em>, <em>e.g.<\/em>, <span style=\"text-decoration: underline;\">State v. Discola<\/span>, 2018 VT 7, \u00b6\u00b6 23\u201324,\u00a0207 Vt. 216 (jury could reasonably infer that defendant touched minor victims\u2019 buttocks with requisite \u201clustful intent\u201d).<\/p>\n<p style=\"text-align: justify;\">Misdemeanor lewdness, now codified at 13 V.S.A. \u00a7 2601a, is not a lesser-included offense of lewd or lascivious conduct with a child under \u00a7 2602. <span style=\"text-decoration: underline;\">State v. Beaudoin<\/span>, 2008 VT 133, \u00b6\u00b6 30\u201339, 185 Vt. 164. Additionally, a three-justice panel has held that lewd or lascivious conduct with a child is not a lesser-included offense of aggravated sexual assault. <u>State v. Grant<\/u>, 2024 WL 167139, at *3\u20135 (Vt.
