Note that there are alternative definitions of \u201charassment\u201d in \u00a0in <a href=\"http:\/\/vtjuryinstructions.org\/?page_id=983\">CR10-418<\/a>, <a href=\"http:\/\/vtjuryinstructions.org\/?page_id=983\">CR10-421<\/a>, and <a href=\"http:\/\/vtjuryinstructions.org\/?page_id=711\">CR22-301<\/a>.<\/p>\n<p style=\"text-align: justify;\">The fourth element of the model instruction reflects the Supreme Court\u2019s decision in <u>State v. Van Buren<\/u>, 2018 VT 95, \u00b6\u00b6 97\u2013103, holding that the State must prove that there was a reasonable expectation of privacy in the image(s). Although the statute\u2019s structure suggests that the reasonable-expectation-of-privacy requirement is a defense, the Court concluded that it is actually an \u201cessential ingredient\u00a0which constitutes the offense\u201d as well as \u201ccentral to the statute\u2019s constitutionality and purpose\u201d and, therefore, an \u201celement of the crime.\u201d <u>Id<\/u>. \u00b6\u00b6 98\u2013101 (quotation and alterations omitted).<\/p>\n<p style=\"text-align: justify;\">Note that the reasonable-expectation-of-privacy standard is \u201cpurely objective,\u201d and this determination accordingly \u201cshould be based on what a reasonable person would think, not what the person depicted thought.\u00a0<u>Id<\/u>. \u00b6 105 (citing <u>State v.
